Terms and Conditions for Landmark Productions

Landmark Productions ("Company") provides real estate photography, videography, drone footage, editing, and media services with professional expertise.

  1. Services Provided

    • Services are as outlined in the client’s booking confirmation or contract, performed with professional equipment.

    • Client must provide property access and prepare it (e.g., staging, cleaning) per the Company’s checklist. Failure to do so may result in rescheduling fees ($50 minimum).

  2. Booking and Agreements

    • Bookings are confirmed upon signed agreement or payment initiation.

    • Written requests are required for service changes, which may incur additional costs.

  3. Payment Terms

    • Full payment is due immediately upon delivery of final products, payable via [methods, e.g., bank transfer, credit card].

    • Delivery is complete when digital files are sent to the client (e.g., via Dropbox link) or physical products are handed over.

    • Late payments incur a 1.5% monthly interest (CA maximum) and a $25 late fee per 30 days overdue.

    • Fees are non-refundable except as noted in Cancellation.

    • Failure to pay within 7 days of delivery may result in legal action or collection efforts, with client liable for costs.

  4. Cancellation and Rescheduling

    • Cancellations more than 7 days before: Full refund.

    • Cancellations 3-7 days before: 50% refund.

    • Cancellations less than 3 days: No refund; full fee due.

    • Rescheduling due to client with less than 7 days notice: $50 fee.

    • Weather or force majeure (e.g., natural disasters) allows rescheduling without fee.

  5. Intellectual Property Rights

    • Company retains copyright. Client gets a non-exclusive license for internal/commercial use (e.g., MLS, social media).

    • Reselling or licensing content requires permission. Company may use content for marketing with client consent 

  6. Liability and Indemnification

    • Liability is limited to the service fee paid; no consequential damages (e.g., lost profits).

    • Client indemnifies Company against claims from property access or client data.

    • Company isn’t liable for equipment failure or third-party issues (e.g., CA FAA drone restrictions). Client must secure permits.

  7. Force Majeure

    • Delays from uncontrollable events (e.g., storms, pandemics) allow rescheduling without penalty.

  8. Dispute Resolution

    • Governed by California law in [your county] courts. Mediation first, with attorney fees per CA Civil Code § 1717.

  9. Acceptance of Terms

    • Booking or payment signifies agreement. Changes require written, signed approval.
